Navigating CTE Claims: A guide for insurers

Chronic traumatic encephalopathy (CTE) is a neurodegenerative brain condition increasingly linked to repeated head injuries and concussions, particularly in elite sport.

As awareness of CTE grows, insurers are beginning to face a complex and evolving risk exposure, shaped by emerging medical research, developing case law and heightened regulatory scrutiny. Adding to this complexity, a definitive diagnosis of CTE is currently only possible following post‑mortem examination.

While known claims have to date been largely confined to elite sport, the CTE claims landscape is expected to develop rapidly as medical understanding advances and litigation expands in Australia and internationally. Insurers are therefore closely monitoring how liability, causation and quantum issues may unfold across a broader range of insured risks.

    Scott Shelly is a Principal in Barry Nilsson’s Insurance & Health team, based in Melbourne. He works closely with insurers, health practitioners and providers, advising on complex medical negligence, liability and coverage matters.     Professor Rowena Mobbs is a cognitive neurologist and Director of Harbour Neurology in North Sydney, and a Visiting Medical Officer at Mater Hospital Sydney. She is recognised as one of Australia’s leading experts in concussion, dementia and CTE, with deep experience in traumatic brain injury and neurodegenerative conditions. Rowena is actively involved in CTE research through her work with the Queensland Brain Institute and plays a key role in advancing understanding of brain injury across both sporting and non-sporting contexts. She also serves as Chief Medical Advisor to ConneCTErs Australia, supporting individuals and families affected by CTE.

  • Christopher Yong

    Christopher is the Business Development Manager at Unisearch Expert Opinion Services, where he leads the Victorian office and connects litigators, insurers, and government practitioners with world‑class expert witnesses. He is a former Technology Lawyer, graduated with First Class Honours, and has served as a Foundation Board Member.
